GuestPilot Terms of Service
The full Terms of Service previously drafted remain in effect, with the following provisions replacing the corresponding sections.
1. Opening

Welcome to GuestPilot.
These Terms of Service ("Terms") govern your access to and use of the GuestPilot website, applications, digital guestbook platform, and related products and services (collectively, the "Service").
GuestPilot is a trade name (d.b.a.) operated by Mountain Business Management, LLC, a Wyoming limited liability company ("GuestPilot," "we," "us," or "our").
By creating an account, purchasing a subscription, publishing a Guestbook, accessing the Service, or otherwise using GuestPilot, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the Service.
2. Definitions
For purposes of these Terms:
"GuestPilot," "we," "us," or "our" means Mountain Business Management, LLC, a Wyoming limited liability company doing business as GuestPilot, together with its applicable affiliates, officers, employees, contractors, agents, successors, and assigns.
All other definitions remain as previously drafted.
3. Free Accounts, Publishing, and Fees
GuestPilot allows Users to create an account and create and preview Guestbooks without charge.
Hosts may create unlimited unpublished Guestbooks without paying a subscription fee.
A paid subscription is required for each listing the Host chooses to publish.
As of the Last Updated date of these Terms, GuestPilot's standard subscription price is:
$29 per year for each published listing.
Pricing may change in the future. Changes to pricing applicable to existing subscriptions will be communicated as required by applicable law and will ordinarily take effect upon a subsequent renewal rather than retroactively during a prepaid subscription period.
Taxes may be added where required.
Promotional pricing, discounts, trials, referral credits, or other offers may be subject to additional terms presented with the applicable offer.
4. Sensitive Information and Property Access
GuestPilot Guestbooks may contain sensitive information relating to a Property, including Property addresses, telephone numbers, Wi-Fi credentials, and non-sensitive arrival instructions.
GuestPilot does not collect or intentionally store physical property-access credentials, including door, gate, garage, lockbox, key-safe, or alarm credentials. Hosts must exchange those credentials through their booking or reservation messaging platform.
GuestPilot employs administrative, technical, and organizational safeguards designed to protect information processed through the Service. Depending upon the information and functionality involved, these safeguards may include encryption, access controls, authentication mechanisms, restricted disclosure, monitoring, and other security measures.
However, no internet-connected service, database, encryption system, transmission method, authentication mechanism, or security control can guarantee absolute security.
Hosts are responsible for:
- determining what access information is appropriate to store in GuestPilot;
- using fields specifically designated for sensitive information when available;
- using available privacy, visibility, concealment, authentication, or access-control features appropriately;
- avoiding unnecessary inclusion of access credentials in ordinary text, photographs, or other unprotected content;
- sharing Guestbook links only with appropriate persons when a Guestbook contains sensitive information;
- keeping Property access information current;
- changing access credentials when reasonably appropriate, including between Guests where appropriate;
- promptly changing or removing credentials that are believed to have been compromised; and
- maintaining appropriate physical and operational security for their Properties.
GuestPilot may provide functionality specifically designed to protect sensitive information. Hosts agree to use such functionality reasonably and understand that placing the same information in ordinary Guestbook text, photographs, external links, or other content may bypass those protections.
GuestPilot does not guarantee that Host Content, Guestbook links, Property access information, or other information can never be accessed, copied, photographed, captured, disclosed, intercepted, forwarded, or misused by an unauthorized person.
A Guest or other authorized recipient may also be technically capable of copying, photographing, screenshotting, recording, or redistributing information after legitimately accessing it. GuestPilot cannot prevent all such conduct.
To the fullest extent permitted by law, GuestPilot is not responsible for theft, trespass, unauthorized entry, vandalism, property damage, loss of property, personal injury, or other harm resulting from a Host's decision to store, publish, distribute, or share Property access information through the Service, except to the extent liability cannot lawfully be excluded or limited.
GuestPilot should not be used as the sole security mechanism for a Property.
5. Artificial Intelligence and Sensitive Information
GuestPilot may use artificial intelligence and automated technologies to assist Hosts with creating, editing, translating, organizing, summarizing, or improving Guestbook content.
AI-generated content may be inaccurate, incomplete, outdated, misleading, inappropriate, or unsuitable for a particular Property or situation.
AI-generated content is a drafting aid and not a substitute for Host review.
Hosts must review AI-generated content before relying upon or publishing it.
Hosts should exercise particular care when reviewing information involving Property access, addresses, directions, emergency procedures, safety, house rules, fees, accessibility, appliance operation, or other information where an error could cause meaningful harm.
GuestPilot may implement technical measures designed to prevent or minimize the unnecessary transmission of sensitive Property access credentials to AI systems or other Third-Party Services.
Hosts should nevertheless avoid entering sensitive credentials into general-purpose AI prompts, free-form text fields, or other locations not specifically designated for such information.
Hosts remain responsible for the final content they publish regardless of whether that content was written by the Host, imported from another source, or generated or modified using an AI Feature.
6. Limitation of Liability — Property Access
The previously drafted limitation-of-liability provisions remain in effect.
For clarity, and to the fullest extent permitted by applicable law, GuestPilot will not be liable for losses resulting from:
- a Host's voluntary entry of property-access credentials into general-purpose Guestbook content despite GuestPilot's guidance;
- a Host's failure to exchange credentials through its booking or reservation messaging platform;
- a Host's failure to change compromised or outdated credentials exchanged outside GuestPilot;
- redistribution, copying, photographing, screenshotting, or disclosure of information by an authorized recipient;
- unauthorized use of credentials exchanged outside GuestPilot, Wi-Fi credentials, or similar Host-provided information; or
- theft, trespass, vandalism, unauthorized entry, or property damage arising from credentials exchanged outside GuestPilot.
Nothing in this section excludes liability that cannot lawfully be excluded.
7. Governing Law
These Terms and any dispute arising out of or relating to GuestPilot or the Service will be governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles, except where applicable law requires otherwise.
8. Dispute Resolution; Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Before filing a formal claim, you and GuestPilot agree to make a good-faith effort to resolve the dispute informally. A party initiating a dispute should provide written notice describing the dispute and requested resolution. The parties will have at least 30 days to attempt informal resolution.
Except for disputes eligible for small claims court and claims seeking injunctive relief for misuse or infringement of intellectual property, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration rather than in court, to the extent permitted by applicable law.
Arbitration will be conducted in accordance with the applicable rules of the American Arbitration Association unless the parties agree otherwise.
YOU AND GUESTPILOT AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION, TO THE EXTENT PERMITTED BY LAW.
If this arbitration provision is found not to apply to a particular dispute, the parties consent to the jurisdiction of the appropriate state or federal courts serving Laramie County, Wyoming, subject to applicable law.
Nothing in this section prevents either party from bringing an eligible individual claim in small claims court.
